1.1. Initial Plan of Development

The property shown on the original plan for Oakledge consisted of some 179 acres, more or less, and was divided into 80 lots. The property was to be developed in accordance with a harmonious plan for the design and relative location of single-family dwellings, roadways, walks and recreational facilities so as to create a community of greatest architectural integrity and high quality. Emphasis was placed on the preservation of the natural beauty of the property. At a later time, additional property was acquired and added to the overall plan, making the total acreage 189 acres, more or less. Whitney & Johnsen, over the course of time, found it desirable to eliminate certain roads and increase the lot sizes, currently resulting in a total of only 63 lots.

1.2. Common Areas and Recreational Facilities

As to any Common Areas so designated in the Subdivision Plan for Oakledge, that Whitney and Johnsen shall, from time to time, have conveyed to the Association, have been so conveyed subject to all easements and restrictions of record and utility easements servicing or otherwise encumbering such Common Areas and the Recreational Facilities located thereon.

(a) On June 14, 1971 Whitney and Johnsen transferred by Warranty Deed to the Oakledge Association land on which common roadways had been constructed and substantially completed. They were: Oakledge Road, West Hill Road, Pine Grove Road, Middlebrook Road, Waterlot Road and a portion of Virburnum Lane. On July 27, 2006 Whitney and Johnsen transferred by Warranty Deed to the Oakledge Association the balance of the roadways and registered a change of road name from Viburnum Lane to Fox Run. This transfer consisted of the balance of Fox Run and two spurs which are part of the road system, namely access to Lot 1802 and access to Lot 1706.

(b) Originally the Oakledge waterfront consisted of only 505 Feet. Subsequently, in 1969 and 1970 Whitney and Johnsen entered into an agreement with two adjoining property owners to purchase an additional 900 feet, more or less, of waterfront, which was added to the existing 505 feet to make contiguous shoreline of 1400 feet, more or less. (No exact measurements exist). To compensate for the above additional purchase of waterfront together with an additional 5 acres, more or less, Whitney and Johnsen and the Oakledge Association entered into a Lease/Purchase Agreement, filed in the Registry of Deeds in Volume 498, Page 419, to lease the Waterfront property and its improvements, for a period of 10 years, renewable for a successive 10 years with an option to purchase any time after January 1, The Oakledge Association exercised its option to purchase the entire Waterfront with its buildings and improvements for $ 50,000 and on January 27, 1990 the property was deeded to the Oakledge Association and recorded in the Registry of Deeds Volume 904, Page 641.

(c) Pursuant to a Warranty Deed, dated March 25, 1975 and recorded in the Registry of Deeds, Vol. 555, Page 17, Whitney and Johnsen transferred to the Oakledge Association a parcel known as Pine Grove Park, to be preserved and maintained as a park for the Oakledge community.
